GENERAL TERMS AND CONDITIONS OF MUZE EARRINGS
Article 1 – Definitions
In these General Terms and Conditions, the following definitions apply:
1.1 Entrepreneur
MUZE Earrings, established in Tilburg, The Netherlands, offering products to consumers through distance selling.
1.2 Consumer
Any natural person acting for purposes outside their trade, business, craft, or profession.
1.3 Distance Contract
A contract concluded between the entrepreneur and the consumer through the webshop or other means of distance communication.
1.4 Product
All jewellery and related items offered by MUZE Earrings.
1.5 Cooling-Off Period
The period during which the consumer may exercise their right of withdrawal.
1.6 Right of Withdrawal
The consumer’s right to withdraw from a distance contract within the statutory cooling-off period.
1.7 Durable Medium
Any instrument that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation, including email.
1.8 Day
A calendar day.

Article 3 – Applicability
3.1 These General Terms and Conditions apply to every offer made by MUZE Earrings and to every agreement concluded through the webshop.
3.2 By placing an order, the consumer confirms that they have read and accepted these General Terms and Conditions.
3.3 Deviations from these General Terms and Conditions shall only be valid if agreed upon in writing.
3.4 If one or more provisions of these General Terms and Conditions are found to be wholly or partially invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Article 4 – Offers
4.1 All offers are non-binding.
4.2 Product descriptions, photographs, and images are presented as accurately as possible. Minor variations in colour, size, or appearance may occur due to screen settings, handcrafted production, or the materials used.
4.3 Obvious errors, printing mistakes, pricing errors, or programming errors shall not bind MUZE Earrings.
4.4 As many products are handmade, slight variations may occur between the product shown and the product delivered.
4.5 If a product is unexpectedly unavailable, the consumer will be informed as soon as reasonably possible.
Article 5 – Formation of the Agreement
5.1 The agreement is concluded when the consumer places an order and the payment has been successfully processed.
5.2 After receipt of the order, the consumer will receive an order confirmation by email.
5.3 MUZE Earrings reserves the right to refuse an order if:

there is an obvious pricing or product error;
-
payment cannot be verified;
-
incorrect information has been provided;
-
fraud, abuse, or misuse is suspected.
5.4 If an order is refused after payment has been received, the paid amount will be refunded as soon as reasonably possible.
Article 6 – Prices
6.1 All prices displayed on the website include VAT.
6.2 Shipping costs will be clearly stated before the consumer completes the order.
6.3 MUZE Earrings reserves the right to change prices at any time.
6.4 Price changes shall not affect orders that have already been placed and paid for.
6.5 Obvious pricing errors or mistakes are not binding upon MUZE Earrings.
Article 7 – Payment
7.1 Payment must be made using one of the payment methods offered through the webshop.
7.2 Orders will only be processed after successful receipt of payment.
7.3 The consumer is obliged to report any inaccuracies in provided or stated payment details without delay.
7.4 If fraud, abuse, or unauthorised use of payment methods is suspected, MUZE Earrings reserves the right to suspend or cancel an order.
7.5 All transactions are processed through secure payment environments provided by recognised payment service providers.
Article 8 – Delivery and Shipping
8.1 MUZE Earrings shall exercise the utmost care when processing and shipping orders.
8.2 Delivery shall take place at the address provided by the consumer during the ordering process.
8.3 Orders placed on business days before 3:00 PM (CET) are generally shipped the same business day, provided the product is in stock.
8.4 Products that are in stock will generally be dispatched within one business day.
8.5 Personalised products, custom-made products, or modifications to existing products will generally be dispatched within a maximum of three business days, unless stated otherwise.
8.6 Delivery times are estimates based on information provided by the carrier. Exceeding a delivery estimate shall not entitle the consumer to compensation or cancellation of the agreement, unless otherwise required by law.
8.7 If an order cannot be fulfilled, or can only be fulfilled partially, the consumer will be informed as soon as reasonably possible.
8.8 The risk of loss or damage to products remains with MUZE Earrings until the order has been delivered to the consumer or a third party designated by the consumer.
8.9 The consumer is responsible for providing a correct delivery address. Additional costs resulting from incorrect address details shall be borne by the consumer.
Article 9 – Right of Withdrawal
9.1 The consumer has the right to withdraw from a purchase agreement within 14 days without giving any reason.
9.2 The withdrawal period begins on the day after the consumer, or a third party designated by the consumer other than the carrier, receives the product.
9.3 During the withdrawal period, the consumer shall handle the product and packaging with care.
9.4 The consumer may only inspect and handle the product as they would be permitted to do in a physical retail store.
9.5 If the product is used beyond what is necessary to determine its nature, characteristics, and functioning, any resulting depreciation may be deducted from the refund.
Article 10 – Exclusion of the Right of Withdrawal
10.1 The right of withdrawal shall not apply to products that have been made according to the consumer's specifications or are clearly intended for a specific person.
10.2 Personalised, custom-made, or specially modified jewellery cannot be returned or exchanged.
10.3 For reasons of health protection and hygiene, all earrings supplied by MUZE Earrings are shipped with a security seal.
10.4 The right of withdrawal expires once the security seal has been broken after delivery.
10.5 Earrings with a broken security seal cannot be returned or exchanged.
Article 11 – Exercising the Right of Withdrawal
11.1 If the consumer wishes to exercise the right of withdrawal, they must notify MUZE Earrings within the withdrawal period via the online withdrawal button on the website or by email to esther@muze-earrings.com.
11.2 The consumer must provide at least:
-
the order number;
-
the products to which the withdrawal relates.
11.3 Providing a reason for withdrawal is not mandatory.
11.4 After notifying MUZE Earrings of the withdrawal, the consumer must return the product within 14 days.
11.5 The consumer shall return the product, including all supplied accessories and packaging, as far as reasonably possible in its original condition.
11.6 The costs of returning the product shall be borne by the consumer.
11.7 The consumer bears the risk of the return shipment until it has been received by MUZE Earrings.
11.8 MUZE Earrings strongly recommends returning products using a Track & Trace service.
Article 12 – Refunds Following Withdrawal
12.1 Upon receipt of a withdrawal request, MUZE Earrings will send a confirmation of receipt on a durable medium.
12.2 After receipt and inspection of the returned product, the purchase price will be refunded no later than 14 days after receipt of the withdrawal request.
12.3 MUZE Earrings may withhold the refund until the returned product has been received or until the consumer provides proof that the product has been returned, whichever occurs first.
12.4 If the product shows signs of use, damage, or does not comply with the return conditions, any depreciation in value may be deducted from the refund.
12.5 If the consumer paid additional costs for a delivery method other than the least expensive standard delivery offered by MUZE Earrings, such additional delivery costs will not be refunded.
Article 13 – Exchanges
13.1 The consumer may request an exchange within 14 days of receiving the order.
13.2 The same conditions that apply to returns also apply to exchanges.
13.3 Exchanges are administratively processed as a return followed by a new order.
13.4 Any price difference between the returned product and the newly selected product shall be settled accordingly.
13.5 Personalised products, custom-made products, and products with a broken security seal are excluded from exchange.
Article 14 – Warranty and Conformity
14.1 MUZE Earrings guarantees that the delivered products comply with the agreement, the reasonable expectations that consumers may have, and all applicable legal requirements at the time of delivery.
14.2 The statutory legal warranty applies to all products.
14.3 Normal wear and tear, damage caused by improper use, impact, dropping, pulling, exposure to water, perfume, cosmetics, cleaning products, or other external influences are not covered by the warranty.
14.4 Minor variations in colour, shape, structure, or natural materials do not constitute a defect and do not entitle the consumer to replacement, repair, or reimbursement.
14.5 If a product has a defect covered by the statutory warranty, MUZE Earrings shall, at its sole discretion, repair the product, replace the product, or provide an appropriate solution.
Article 15 – Liability
15.1 MUZE Earrings shall only be liable for direct damages resulting from an attributable failure to fulfil its obligations under the agreement.
15.2 The liability of MUZE Earrings shall be limited to the amount paid by the consumer for the product concerned.
15.3 MUZE Earrings shall not be liable for indirect damages, consequential damages, loss of profit, loss of savings, or any other form of financial loss.
15.4 MUZE Earrings shall not be liable for damages resulting from:
-
improper or unintended use of the product;
-
normal wear and tear;
-
incorrect storage of the product;
-
exposure to water, perfume, cosmetics, cleaning products, or other chemical substances;
-
modifications or repairs carried out by third parties.
15.5 The limitations of liability set out in this article shall not apply in cases of wilful misconduct or gross negligence on the part of MUZE Earrings.
Article 16 – Complaints Procedure
16.1 MUZE Earrings maintains a clearly accessible complaints procedure.
16.2 Complaints regarding the performance of the agreement must be submitted within a reasonable period after the consumer has discovered the issue.
Complaints can be submitted via:
16.3 The consumer should provide at least:
-
their name;
-
the order number;
-
a description of the complaint;
-
photographs, where applicable.
16.4 Complaints will be answered within 14 days of receipt.
16.5 If a complaint requires a longer processing time, the consumer will receive an acknowledgement of receipt within 14 days together with an indication of when a substantive response can be expected.
16.6 Submitting a complaint does not suspend the consumer's payment obligations.
Article 17 – Privacy and Personal Data
17.1 MUZE Earrings processes personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).
17.2 Personal data is processed solely for:

processing orders;
-
delivering products;
-
customer service purposes;
-
compliance with legal obligations;
-
marketing purposes where the consumer has provided consent.
17.3 Further information regarding the processing of personal data can be found in the Privacy Policy of MUZE Earrings.
Article 18 – Intellectual Property Rights
18.1 All intellectual property rights relating to the website, designs, product photographs, texts, logos, trade names, images, and other content belong to MUZE Earrings or its licensors.
18.2 No material from the website may be copied, reproduced, distributed, published, or otherwise used without the prior written consent of MUZE Earrings.
18.3 Nothing on the website shall be interpreted as granting any licence or transfer of intellectual property rights.
Article 19 – Force Majeure
19.1 MUZE Earrings shall not be obliged to fulfil any obligation if prevented from doing so by circumstances constituting force majeure.
19.2 Force majeure includes, but is not limited to:

internet or telecommunications failures;
-
cyberattacks;
-
illness;
-
pandemics;
-
government measures;
-
strikes;
-
transportation disruptions;
-
delays caused by suppliers;
-
natural disasters;
-
fire;
-
war or threat of war;
-
any other circumstance beyond the reasonable control of MUZE Earrings.
19.3 During a force majeure situation, the obligations of MUZE Earrings shall be suspended.
19.4 If the force majeure situation continues for more than 30 days, both parties shall have the right to terminate the agreement in whole or in part without any obligation to pay compensation.
Article 20 – Governing Law and Disputes
20.1 All agreements between MUZE Earrings and the consumer shall be governed exclusively by the laws of The Netherlands.
20.2 The applicability of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
20.3 Any disputes shall be submitted to the competent court in The Netherlands, unless mandatory legal provisions require otherwise.
20.4 Consumers residing within the European Union may also make use of any available statutory out-of-court dispute resolution procedures where applicable.
Article 21 – Final Provisions
21.1 If one or more provisions of these General Terms and Conditions are found to be wholly or partially invalid or unenforceable, the remaining provisions shall remain in full force and effect.
21.2 MUZE Earrings reserves the right to amend these General Terms and Conditions.
21.3 Amendments shall be published on the website and shall only apply to agreements concluded after the date of publication.
21.4 In situations not covered by these General Terms and Conditions, MUZE Earrings shall decide in accordance with applicable laws and regulations and the principles of reasonableness and fairness.
21.5 The most recent version of these General Terms and Conditions is always available via www.muze-earrings.com.
